I’ve known John Simon for ten years since he arrived in Bellingen, Mid-North Coast, New South Wales, Australia.

I used to think John Simon was a good guy but lately he’s really lost the plot.

There are those in the Bellingen community who believe that John Simon has been “Bad John Simon” or “Dishonest and Deceptive John Simon” or “Arrogant John Simon” for a long time.

Take for example Peter Stone owner of Real Estate of Distiction, a local real estate agent.

On 11 November 2014, the proceedings in the Coffs Harbour District Court between Real Estate of Distinction and John Simon, both from Bellingen NSW, settled out of Court.

The proceedings were brought by Peter Stone, principal of Real Estate of Distinction (REOD), in February 2014.  The claim was for $106,500 being 100% of a commission that REOD claimed it was entitled to from the sale of 4 Gilwinga Drive, Bayview in Sydney.

REOD claimed while an agent of REOD, Mr. Simon negotiated the sale of the property to a purchaser that first visited the property during a period that REOD was appointed by the vendor to sell the property.

The claim was based on the allegation that Mr. Simon secured the sale while agent of REOD but negotiated a better commission for the sale of the property through another Bellingen agency.  The claim alleged Mr. Simon was entitled to 25% of the commission through REOD but instead he arranged to receive 80% of it from the other agency, then terminated his relationship with REOD, then caused the sale of the property to occur for $4.825 million through the other agency.

Mr. Simon received a commission of $77,200 plus GST for arranging the sale through the second agency, significantly more than he was entitled to receive from REOD.

The case settled out of Court on the second day of the hearing.  Mr. Simon paid REOD $60,000 which was c.77% of the amount Mr. Simon received.  Mr. Simon also paid REOD 50% of its legal costs in the proceedings.  In total, Mr. Simon paid REOD approximately $86,000 to settle REOD’s claims plus had to pay his own costs of defending the proceedings.
